This policy applies to Dalich Pty Ltd t/a (ABN 50 074 445 097) Money Centre Croydon Australian Credit License No. 389799 and its related bodies corporate (collectively ‘we’, ‘us’ or ‘our’) endeavour at all times to comply with the Privacy Act 1988 and the Australian Privacy Principles which together will be referred to in this policy as “Australian Privacy Law.”

We are committed to protecting the personal information we collect and hold about you.

We recognise that any personal information we collect about you will only be collected, held, used or disclosed for the purposes we have collected it for or as allowed under the law (such as under the Anti-Money Laundering and Counter Terrorism Financing Act 2006 (Cwth), the Privacy Act 1988 (Cwth) or the National Consumer Credit Protection Act 2009 (Cwth)). It is important to us that you are confident that any personal information is to abide by the Australian Privacy Principles for the protection of personal information, as set out in the Privacy Act (1988) (Cwth) and any other relevant law.

This General Privacy Policy applies to all persons accessing our website, dealing with us or from whom we otherwise collect personal information. We also collect personal and (consumer) credit information provided by persons applying for or receiving credit from us and, in doing so, endeavour at all times to comply not only with Australian Privacy Law, in general, but also with the Credit Information Privacy Code. Responsible Lending 

Money Centre is committed to responsible lending.

We adhere to responsible lending practices. As a responsible lender, we aim to lend only what you can afford to repay. We stick to the letter of the law and have some cool technology in place to help us make the right decisions to try to make your life easier, not harder. Some of the checks that we do include:

  • We make enquiries about your financial situation, including asking questions about income, expenses and employment status to help us understand your current circumstances.
  • We take steps to verify your financial situation, including reviewing your bank transaction history and other information disclosed during your application.
  • We make inquiries about your requirements and objectives, including asking you about the purpose of your loan.

We’re transparent. We show you a full breakdown of all your fees and repayments before you confirm your loan. There are no sneaky hidden fees. We hold an Australian Credit License. Our Credit License No. 389799 is issued by the Australian Securities and Investment Commission and means that we must comply with the National Consumer Credit Protection Act 2009 (Cwth), including making sure we lend responsibly.

We take extra special care to make sure that every loan we offer you is affordable for, and every loan meets your needs, objectives, and requirements.

We support customers facing financial difficulty. Financial difficulty can arise from different life events such as change in income, illness, a relationship breakdown, reduction in your cash flow or emergency events. We encourage customers facing financial hardship to talk to us. We will treat every case individually. Your Privacy is paramount.

 

Personal Information

When we refer to personal information we mean information or an opinion about an identifiable individual, or an individual who is reasonably identifiable. This information may include information or an opinion about you. The personal information we hold about you may also include credit-related information.

Pseudonyms 

You are not required to provide us with your name or any personal information if you do not wish to. You are free to use any name allowed by law. We, however, will not deal further with you without obtaining your real name and other verifiable pieces of personal information.

We are not permitted by law to provide you with credit without obtaining proof of your identity and that is covered in our Credit Information Privacy Policy.

Collection of personal information

In most circumstances it will be necessary for us to identify you in order to successfully do business, including answering general inquiries about our product or current promotional offers, however depending on the circumstances we may in some instances do business with you without you providing us with personal information. However the extent of the information and services we may be able to provide will be limited.

The kinds of personal information we may collect and hold about you depends on your relationship with us (such as whether you are a customer or an employee) and may include:

  • your name;
  • address, previous addresses and how long you have lived at those addresses;
  • date of birth;
  • your employer, previous employers and how long you have been in such employment;
  • your email address;
  • your telephone numbers;
  • the details of any references you supply, including the names and addresses of your referees.

  • number of dependants

  • transactional history (e.g. payment history and loan balances),

  • any other information we may need to identify you such as your passport, Driver’s Licence.

By accessing this website or otherwise dealing with us you agree to our General Privacy Policy in relation to the collection of personal information by the website. As a result of your visit to our website, we may collect and store information about your visit to this website including:

  • the domain name and IP address of the computer from which you accessed the internet;
  • the date and time you accessed the website;
  • the internet address of the website from which you linked directly to our website;
  • the pages you accessed while visiting the website; and
  • through the use of websites, software and internet tracking devices such as cookies, anonymous identifiers and session variables, we may also collect your email address.
  • Your internet service provider or the providers of your internet browser software may also collect such information for their own purposes. We are not responsible for the collection, storage and use of such information by these entities and refer you to their respective privacy policies.

If you apply to us for credit information we will collect and store credit information in addition to the above personal information and this will be governed by our Credit Information Privacy Policy.

Credit-related information means:

  • Credit information, which is information which includes your identity; the type, terms and maximum amount of credit provided to you, including when that credit was provided and when it was repaid; repayment history information (including overdue payments); payments information; new arrangement information; details of any serious credit infringements; court proceedings information; personal insolvency information and publicly available information; and 
  • Credit eligibility information, which is credit reporting information supplied to us by a credit reporting body, and any information that we derive from it.

The main consequences of us not collecting personal information are an inability or delay in being able to identify you, contact you or provide services to you.

Due to the nature of the services provided by us, some of the information we collect may be sensitive information. Sensitive information is information about your racial or ethnic origin, political opinion, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or trade association, membership of a trade union, sexual preferences or practices, criminal record, health information, or genetic or biometric information.

If you apply to us for employment, we may also collect and store personal and, in addition, sensitive information about you including your:

  • education, training and other qualifications;
  • work history;
  • professional or trade associations or union membership;
  • hobbies and other interests; and
  • criminal history.

Electronic collection

We will collect information from you electronically, for instance through internet browsing, mobile or tablet applications. 

We use a technology called ‘cookies’ to provide you with better and more customised service and with a more effective website and mobile application (Site). A ‘cookie’ is a small text file placed on your computer by our web page server. A cookie can later be retrieved by our webpage servers. Cookies are frequently used on websites and you can choose if and how a cookie will be accepted by configuring your preferences and options in your internet browser.

How we collect your personal information

As a result of you dealing further with us, we may collect personal information directly from you and this may be in person, over the telephone, by mail, over the internet, by email or by completion of an application or consent form whether on-line or otherwise.

If you:

  • apply to us for credit;
  • agree to guarantee credit from us to another person;
  • receive credit from us;
  • apply to us to vary the terms of your payments under your credit contract on the grounds of hardship; or
  • apply for employment with us;

We may collect personal, credit and sensitive information about you from other sources when it is impractical or unreasonable for us to collect it directly from you. Among these other sources may be:

  • a credit reporting body;
  • someone authorised by you such as an agent, broker, accountant, solicitor, financial counsellor, introducers or a guarantor;
  • a referee;
  • an employer;
  • a government body;
  • another financial institution;
  • a professional or trade association or trade union;
  • our agents

and we may collect that information directly from them in person, over the telephone, by mail, over the internet, by email or fax or by completion of an application or consent form whether on-line or otherwise.

How we hold your personal information

We use our best endeavours and take all reasonable steps to secure your personal information including:

  • maintenance of a secure environment for storage of information whether in hard copy or in electronic form;
  • requiring that access to such information be confined to authorised personnel only;
  • using technology such as encryption and password protection to secure any information kept in electronic form.

We are not responsible for the security of any computer or other device which you use to access our website.

Purposes of collection of personal information

We collect your personal and credit related information so we can:

  • identify you and conduct appropriate checks on you and/or any security;
  • understand your requirements and provide you with a product or service;
  • set up, administer and manage our products, including the management and administration of underwriting, and obtaining loan assessments and credit reports;
  • assess your eligibility to be provided with finance and to manage the credit services we provide to you;
  • manage, train and develop our employees and representatives, and providing continuing employment (in relation to our employees only);
  • managing our relationship with you, including debt collection;
  • manage complaints and disputes, and report to regulatory authorities and dispute resolution bodies;
  • performing research and statistical analysis, including for customer satisfaction and product and service improvement purposes. This may include matching information we collect against other information held by third pirates. (We may also use and disclose deidentified data for these purposes);
  • helping us tailor existing or develop new products, services or offers which may be offered to you, and to help us selectively target promotional offers and opportunities to your needs; and
  • developing or seeking to deliver new ranges of products or services.
  • Search and register security interests on the Personal Property Securities Register

You must not give us inaccurate or incorrect information, or omit to provide us with information as we may not be able to provide you with our services. If we hold sensitive information about you, we will not use the sensitive information for direct marketing purposes unless you specifically consent to us doing so.

Where reasonable and preactival we will collect your personal information directly from you. We may also collect your personal information from credit reporting bodies, your bank account providers, our service providers, finance brokers and third party social media platforms such as Facebook. We also collect information when you interact with our Site.

Notifiable matters

The law requires us to advise you of ‘notifiable matters’ in relation to how we may use your credit-related information. You may request to have these notifiable matters (and this privacy and credit policy) provided to you in an alternative form.

We exchange your credit-related information with credit reporting bodies. Credit providers (such as us) assess your creditworthiness, assess your application for finance and manage your finance.

If you fail to meet your payment obligations in relation to any finance that we have provided or you have committed a serious credit infringement, then we may disclose this information to a credit reporting body.

You have the right to request access to the credit-related information that we hold about you and make a request for us to correct that credit-related information i needed. Please see the heading ‘Access and correction to your personal information’ below.

Sometimes your credit-related information will be used by credit reporting bodies for the purposes of ‘pre-screening’ credit offers on the request of other credit providers. You can contact the credit reporting body at any time to request that your credit information is not used in this way.

You may contact the credit reporting body to advise them that you believe that you may have been a victim of fraud. For a period of 21 days after the credit reporting body receives your information, the credit reporting body must not use or disclose that credit-related information. Security Information

We will take reasonable steps to protect your personal information by storing it in a secure environment. We may store your personal information in paper and electronic form. We will also take reasonable steps to protect any personal information from misuse, loss and unauthorised access, modification or disclosure.

Disclosure of information

We may disclosure your personal information to third party service providers we contract with to perform certain functions on our behalf such as:

  • debt collection services;
  • Illion, Equifax or Experian, any any related bodies corporate; and 
  • database providers who collect (sometimes through the use of first-party cookies, third-party cookies or other third-party identifiers), hold, use and disclose information in order to assist with identity verification, credit scoring and credit reporting bodies, debt collectors and lead providers.

We may also disclose your information to:

  • any of our related bodies corporate;
  • direct marketers (that is, associated businesses that may want to market products to you). If you do not wish to receive marketing information, you may at any time decline to receive such information by contacting us in any of the ways listed at the end of this policy. If the direct marketing is by email you may also use the unsubscribe function. We will not charge you for giving effect to your request and will take reasonable steps to meet your request at the earliest possible opportunity;
  • anyone who represents you or anyone to whom you have consented to the information being disclosed;
  • investors, agents or advisors or any entity that has an interest in, or is considering acquiring an interest in, our business or your loan contract;
  • where we are required or permitted to do so by law, such as under the:
    • Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cwth);
    • National Consumer Credit Protection Act 2009 (Cwth);
    • Personal Property Securities Act 2009 (Cwth).
  • companies that provide information and infrastructure systems to us;
  • lead generation businesses and other credit providers. We may exchange or sell your information (including personal information and credit-related information) to third party lead generation companies or other credit providers who may use that information for any of the purposes for which we can use it. That information may also be disclosed to agents, contractors or advisors of the lead generation business or other credit providers;
  • online third party messenger applications, such as Facebook messenger, for the purposes of contacting you;
  • social media platforms, such as Facebook, for marketing related purposes;
  • to third parties that assist us to enhance our business performance and/or the scope and quality of our services to you such as:
    • website behaviour analysis providers;
    • interest data, remarketing and network impression reporting providers;
    • customer, product, business or strategic research and development organisations;
    • administration or business management services, consultancy firms, auditors and business management consultants;
    • print/mail/digital service providers;
    • imaging and document management service;
    • search engine optimization service providers;
    • credit reporting agencies; and
    • to your employer, referees or identity verification services. 

Prior to disclosing only of your personal information to any other person or organisation, we will take all reasonable steps to satisfy ourselves that:

  • The person or organisation has a commitment to protecting your personal information that is at least equal to our commitment; or
  • You have consented to us making the disclosure.

We may collect and hold credit-related information and exchange this information with credit reporting bodies and other entities for the purposes of assessing your application of finance and managing finance.

This credit-related information may be held by us in electronic form on our IT servers and may also be held in paper form. We may use cloud storage to store the credit-related information we hold about you and the IT servers may be located on or outside Australia.

When we obtain credit eligibility information from a credit reporting body about you, we may also seek publicly available information and information about any serious credit infringement that you may have committed. We may disclose your credit-related information to entities that provide support functions to us. 

The purposes for which we collect, hold, use and disclose your personal information

If you are a user of our website, a prospective customer, a customer or guarantor of a customer’s credit, a contractor or supplier of goods and services to us, a job applicant or other person from whom we collect, hold, use and disclose your personal information we shall do so only for those purposes which are:

  • permitted by Australian Privacy Law;
  • necessary for:
    • the administration of any contract of supply of goods or services to or by us;
    • the provision of our products to our customers;
    • the consideration of any proposed guarantee of credit;
    • assessment and processing of any job application;
    • otherwise for the administration and management of our business;
  • better improve website useability;
  • required by law;
  • in order to investigate or assist with any investigation into any complaint about the conduct of our business, in particular, under Australian Privacy Law;
  • to otherwise enforce any term of any contract or other right which arises out of our dealings with you.;
  • to communicate with you, by way of direct marketing, information about our products and services. If you do not wish us to do so, you can “opt out” of such communication by informing us in person, by telephone, by facsimile, by post or by email;
  • to search and/or register any Personal Property Securities;
  • as part of a prospective sale, transfer or restructure of our business; or
  • to otherwise communicate with you or the purposes outlined above.

In addition, if you apply to us for credit or receive credit from us, we will collect, hold, use and disclose your personal information in order to:

  • assess your credit application;
  • manage your credit contract;
  • consider any application for variation of your payments whether or not on the grounds of hardship;
  • collect any debt or otherwise enforce any rights arising under your credit contract.

We may disclose your personal information, including credit and sensitive information, to other parties as part of a process of merger, acquisition, sale of our business or our other assets and, before doing so, will give you notice and an opportunity to opt out of the provision of such information in that instance.

If, for any of the above purposes, we disclose your personal information to any supplier of services to our business or to any prospective purchaser of our business which we shall do so only if it is necessary for the purposes listed above, we shall:

How you may access your personal information held by us

If we are unable to grant your access to personal, sensitive or credit information, we will give you our reasons in writing within a reasonable time. These may include where providing the information to you may:

  • reveal personal information about another individual person;
  • pose a threat to the health or safety of another individual person;
  • not be permitted by law;
  • reveal internal information of a commercially sensitive nature which is not required to be disclosed to you by Australian Privacy Law.

Updating your personal information

It is important to us that the personal information we hold about you is accurate and up to date. During the course of our relationship with you we may ask you to inform us if any of your personal information has changed. If you wish to make any changes to your personal information, you may contact us. We will generally rely on you to ensure the information we hold about you is accurate or complete.

How you may correct any personal information we hold about you which is incorrect

If you believe any personal information which we hold about you is incorrect, please contact us in person by telephone, by facsimile, by email, identify yourself and tell us what information which we hold about you is, in your belief, incorrect and how you want it changed.

If we cannot agree to the change to the information which you have requested, we will give you reasons in writing.

Access and correction to your personal and credit-related information

We will provide you with access to the personal information we hold about you. You may request access to any of the personal information we hold about you at any time by contacting us We may charge a fee for our costs of retrieving and supplying the information to you.

Depending on the type of request that you make we may respond to your request immediately, otherwise we usually respond to you within 7 days of receiving your request. We may need to contact other entities to properly investigate your request.

There may be situations where we are not required to provide you with access to your personal information, for example, if the information relates to existing or anticipated legal proceedings, or if your request is frivolous. An explanation will be provided to you, if we deny you access to the personal information we hold about you.

If any of the personal information we hold about you is incorrect, inaccurate or out of date you may request that we correct the information by contacting us in any of the ways listed at the end of this policy. If appropriate we will correct the personal information at the time of the request, otherwise, we will provide an initial response within 7 days of receiving your request. Where reasonable, and after our investigation, we will provide you with details about whether we have corrected the personal or credit-related information within 30 days. We may need to consult with other finance providers or credit reporting bodies or entities as part of our investigation. If we refuse to correct personal information we will provide you with our reasons for not correcting the information.

Using government identifiers 

If we collect government identifiers, such as your tax file number, Medicare number, passport number or driver’s licence number, we do not use or disclose this information other than as required or permitted by law. We may use government identifiers to verify your identity when you deal with us.

How you may complain about how we deal with your personal information

If you are not satisfied with the reasons referred to above or otherwise have any complaint about how we collect, hold, use or disclose your personal information please contact our Privacy Officer who will then follow our Privacy Internal Dispute Resolution process.

Complaints

If you are dissatisfied with how we have dealt with your personal information, or you have a complaint, you can contact our complaints officer in any of the ways listed at the end of this policy.

 We will acknowledge your complaint within 7 days. We will use our best efforts to provide you with a decision on your complaint within 30 days. If you are dissatisfied with the response of our complaints officer you may make a complaint to our External Dispute Resolution Scheme, the Australian Financial Complaints Authority, which can be contacted on either www.afca.org.au or 1800 931 678 or Privacy Commissioner, who can be contacted on either www.oaic.gov.au or 1300 363 992.

Resolving Complaints 

We do our best to resolve your complaint on the spot, but sometimes that may not be possible. 

Here are a couple of steps to follow towards resolving an issue:

Get in touch with one of our call centre team members to help resolve your complaint. We aim to resolve complaints as quickly as possible. If you’re not satisfied with the resolution you get from our call centre team, you can have your complaint independently reviewed by our internal dispute resolution (IDR) team.

If you are still concerned about the complaint, you can contact the Australian Financial Complaints Authority (AFCA). Just a heads up that if you contact AFCA before your complaint has been reviewed by our internal dispute resolution team, they will refer you back to us. AFCA’s details are set out below.

Changes to this Policy

From time to time, we may make changes to this General Privacy Policy because of:

  • changes to the law;
  • changes to technology;
  • changes to our systems.

We will notify such changes on our website. Where the changes may affect you in a particular way, and you have a credit contract with us, we will notify you if required by Australian Privacy Law and our Credit Information Privacy Policy.
